Decree-Law no. 36/2022, of 20 May, was published, establishing an exceptional and temporary regime in the scope of price revisions in response to the increase in raw materials, materials, labor and equipment costs. support, with an impact on public procurement. The objective of this regime is to avoid interruptions in public investment, at a time when there is an abrupt increase in prices, causing great pressure on the works.
Until December 31, 2022, a contractor may request an exceptional price revision, provided that any material, type of labor or equipment represents at least 3% of the contractual price, and has a year-on-year rate of change of the same cost. or greater than 20%.
The proposal must be submitted by the contractor to the owner of the work, the latter having a period of 20 days to accept the proposal, present a counter-proposal or carry out a price review as provided for by law.
